Terms of use

1. Who we are

Fireworks Bible is operated by Fireworks Bible, LLC, an Ohio limited liability company. These Terms of Use are an agreement between you and Fireworks Bible, LLC. In these terms, the words we, us and our mean Fireworks Bible, LLC. The word you means the person using the service.

These terms cover the website at www.fireworksbible.com, the application at app.fireworksbible.com, and every page, feature, file and data set we make available through them. All of that is called the service.

By creating an account, signing in, or using the service, you agree to these terms. If you do not agree, do not use the service.

2. What the service is

Fireworks Bible is a reference and price comparison tool for consumer fireworks. It lists products, product details, photographs, effects, and prices reported at named stores.

We sell nothing. We do not sell fireworks. We do not take orders, hold inventory, ship anything, or process any payment between you and a store. Any purchase you make is between you and the seller, on the seller's terms.

We are not a fireworks retailer, a manufacturer, a distributor, or an agent or broker for any of them.

3. You must be 18 or older

You must be at least 18 years old to create an account or use the service. By using the service you confirm that you are at least 18.

The age at which a person may buy or possess fireworks is set by state and local law and is not always 18. Nothing here permits you to buy, possess, or use anything that the law where you are does not permit.

4. Your account

Access to the service requires an account. You sign in with your email address and a one time code. Accounts are approved by us before they become active, and we may decline any request without giving a reason.

We may suspend or close an account at any time, with or without notice, including when we believe these terms have been broken, when an account is used to collect or redistribute our data, when submissions are inaccurate or not original, or when we stop offering the service.

You may close your account at any time by emailing support@fireworksbible.com from the address you signed in with.

When an account closes, your right to use the service ends and access to the data on your device is withdrawn. Sections that by their nature should survive, including the content license, the disclaimers, the limitation of liability, the indemnity, and governing law, continue to apply.

5. Price, availability and product data are provided as-is

Prices, product details and store information are provided as-is, with no warranty of any kind. We do not promise that anything in the catalog is accurate, complete, current, or fit for any purpose.

Confirm the price, the product and its availability with the store before you rely on anything you see here.

6. No affiliation with any store, manufacturer or brand

We are not affiliated with, endorsed by, sponsored by, or approved by any store, manufacturer, distributor or brand named in the service.

Product names, brand names, store names, logos and trademarks belong to their owners. We use them only to identify the products and the places they were seen. Their appearance in the service does not indicate any relationship between that owner and us.

A store or brand owner who wants its logo or listing removed may write to support@fireworksbible.com, and we will act on the request promptly.

7. State law and safety content is information, not advice

The service includes plain language summaries of state fireworks law, safety material, and show planning material. All of it is general information.

You are responsible for knowing and following the law where you are, and for using fireworks safely. Consult a lawyer, your fire marshal, or your local authority when it matters.

8. Acceptable use

You may use the service for your own personal, non-commercial reference. You may not do any of the following.

We monitor for automated collection and account sharing, and we may suspend or close an account we believe is doing either.

9. Content you submit

The service lets you submit photographs, price reports, product details, store notes, community posts, scores, ratings and comments. All of that is called your content.

You keep ownership of your content. You are not assigning it to us.

You grant Fireworks Bible, LLC a perpetual, worldwide, irrevocable, royalty free, non-exclusive, transferable and sublicensable license to use, host, store, reproduce, modify, adapt, publish, distribute and display your content in the service, on our websites, and in marketing and promotional material for the service. The license continues after your account closes.

When you submit content you promise all of the following.

We may accept, reject, edit, hold or remove any submission, and we may reverse credit for a submission later found to be inaccurate or not original. Those decisions are ours to make.

We may publish your display name and the date next to content you contribute.

Never ignite, test or use a product in order to submit content. No submission requires it and nothing in the service rewards it.

10. Community scores and store ratings are opinions

Scores, ratings, reviews and comments in the service are the personal opinions of the users who wrote them. They are not our statements, we do not adopt them, and we do not verify them.

An average score is a calculation from user submissions and nothing more. It is not a measure of quality, safety or value, and it does not reflect our view of any product, store or brand.

A store or brand that believes a rating or a price is wrong may write to support@fireworksbible.com. We will review it and correct anything we find to be in error.

11. Our content

The service, including its design, text, software, arrangement, and the selection and compilation of the catalog, belongs to Fireworks Bible, LLC or is used with permission. Fireworks Bible and the Fireworks Bible logo are our marks.

We grant you a limited, personal, revocable, non-transferable license to use the service for your own reference while your account is active. No other right is granted, by implication or otherwise.

12. Copyright complaints

We respect copyright and we respond to proper notices under the Digital Millennium Copyright Act, 17 U.S.C. section 512. We remove material that is the subject of a valid notice, and we close the accounts of repeat infringers.

If you own a copyright and believe material in the service infringes it, send a written notice to our designated agent that includes all of the following.

If your material was removed and you believe the removal was a mistake or a misidentification, you may send a counter notification to the same agent. It must identify the removed material and where it appeared, include your name, address, telephone number and email address, include a statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification, and include your consent to the jurisdiction of the federal district court for the district where you live, or, if you are outside the United States, for any district in which we may be found, and your agreement to accept service of process from the person who gave the notice.

A notice or counter notification that makes a material misrepresentation can make the person who sent it liable for damages under 17 U.S.C. section 512(f).

13. Links to other sites

The service links to store sites, manufacturer sites and videos we do not control. We are not responsible for their content, their accuracy, their products, or their privacy practices. A link is not an endorsement.

14. Disclaimer of warranties

The service is provided as-is and as available, with all faults and without warranty of any kind. To the fullest extent the law allows, we disclaim all warranties, express, implied and statutory, including any implied warranty of merchantability, fitness for a particular purpose, title, accuracy and non-infringement.

We do not warrant that the service will be uninterrupted, timely, secure or error free, that defects will be corrected, or that any data in it is accurate, complete or current. No advice or information you get from us or through the service creates any warranty.

Some states do not allow the exclusion of certain implied warranties, so parts of this section may not apply to you.

15. Limitation of liability

To the fullest extent the law allows, Fireworks Bible, LLC and its members, managers, officers, employees and contractors will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, or the cost of substitute services, arising out of or relating to the service, on any theory of liability, even if we were told such damages were possible.

We are not liable for any loss, injury, property damage, fine or penalty arising out of your purchase, possession, transport, storage, discharge or use of any firework, or out of your reliance on any price, product detail, availability, safety statement or summary of law in the service.

Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or one hundred dollars.

Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.

16. Indemnity

You agree to defend, indemnify and hold harmless Fireworks Bible, LLC and its members, managers, officers, employees and contractors from any claim, demand, loss, liability, damage, fine, judgment, cost and expense, including reasonable attorney fees, arising out of or relating to your use of the service, your content, your breach of these terms, or your violation of any law or the rights of anyone else.

We may take over the defense of any matter subject to this section at your expense, and you will cooperate with us. You will not settle any matter in a way that imposes any obligation on us without our written consent.

17. Changes

We may change, suspend or stop any part of the service at any time.

We may change these terms. The current version is always posted at www.fireworksbible.com/terms with the effective date at the top. If a change is material we will make a reasonable effort to tell account holders, by email or by a notice in the service, before it takes effect. Using the service after a change takes effect means you accept the changed terms. If you do not accept them, close your account.

18. Governing law and venue

These terms and any dispute arising out of them or the service are governed by the laws of the State of Ohio, without regard to its conflict of laws rules.

The state and federal courts located in [county] County, Ohio have exclusive jurisdiction over any such dispute. You and we each consent to the personal jurisdiction of those courts and waive any objection to venue there or any argument that the forum is inconvenient.

19. General

These terms, together with the privacy policy, are the entire agreement between you and us about the service, and replace anything said or written before about the same subject.

If any part of these terms is held unenforceable, the rest stays in force and the unenforceable part is limited to the smallest extent needed to make it enforceable.

Our failure to enforce any part of these terms is not a waiver of it. You may not assign these terms. We may assign them to a successor to our business.

There are no third party beneficiaries to these terms. Headings are for convenience only.
